2. Service Description
Griefur is a pet memorial and grief support platform providing:
- Pet story sharing and community support
- Pet end-of-life care knowledge and guidance
- Grief healing resources and daily guides
- Pet memorial creation and management
- Member subscriptions with expert article access and a monthly Companion credit allowance
3. Eligibility
You must be at least 13 years of age to use our Services. If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you may only use the Services with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.
In compliance with the Children's Online Privacy Protection Act (COPPA), we do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will delete that information promptly.
You may not use our Services if you are prohibited from doing so under applicable law or have been previously banned from our Services.
4. User Accounts
When creating an account, you must provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

By posting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, distribute, display, and perform your User Content in connection with operating and promoting the Services.
You are solely responsible for your User Content and the consequences of posting it. You represent and warrant that you own or have the necessary rights to post your User Content and that it does not violate any third-party rights.
Prohibited content includes but is not limited to:

User Content remains the property of its respective owners, subject to the license granted to us in these Terms.
If you provide us with any feedback, suggestions, or ideas, you grant us the right to use such feedback without restriction or compensation to you.
8. Payments and Subscriptions
Some features of our Services are available through subscription plans billed monthly or annually. All fees are stated in US dollars unless otherwise specified.

We reserve the right to change our pricing at any time. Price changes will not affect existing subscriptions until renewal.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Services will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected.

10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GRIEFUR AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

You agree to defend, indemnify, and hold harmless Griefur and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.
12. Termination
We may suspend or terminate your access to the Services at any time, with or without cause and with or without notice, at our sole discretion.
Upon termination, your right to use the Services will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

YOU AND GRIEFUR AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
For users outside the United States, you agree to the exclusive jurisdiction of courts located in Delaware, USA, subject to applicable local consumer protection laws that may provide otherwise.

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
